Whistleblowing channel: launch of the Independent Whistleblower Protection Authority (AIPI)
On September 1, the Independent Whistleblower Protection Authority (AIPI), established under Law 2/2023 of February 20—which regulates the protection of individuals who report regulatory breaches and aims to combat corruption—officially became operational.
The AIPI is vested with powers relating to the external reporting channel, whistleblower protection and support, and sanctioning authority. In theory, from now on, anyone who detects an infringement within an organization involving any of the matters set out in Article 2 of the aforementioned law may report it either through the company’s internal channel or to the AIPI (or to the relevant regional authority, provided the latter has been established).
This is undoubtedly a step forward in the implementation of Law 2/2023, which seeks to bring irregularities to light and protect whistleblowers from potential retaliation.
