NIE or NIF? Procedures for investing in Spain

Baker Tilly Sep 25, 2026

Are you an executive or investor, or do you represent a French company with a project in Spain? You may be planning to establish a subsidiary, acquire a stake in a company or acquire a Spanish company. As soon as the project gets underway, a very practical question arises: do you need a Spanish NIE or NIF?

NIE for individuals

The NIE (Foreign Identity Number) is the personal identification number assigned to foreign nationals in Spain.

In a corporate context, it may be required in two situations, for example. The first is when a French executive is appointed as a director of a Spanish company. The second is when a French individual invests directly in Spain.

It is advisable to identify, from the outset of the project, the individuals who will be involved in the transaction or in the governance of the Spanish company.

NIF for the investing French company

A French company directly involved in a transaction in Spain may need its own Spanish NIF (Tax Identification Number).

It is particularly important to plan ahead when the company intends to establish a subsidiary in Spain, subscribe to a share capital increase or acquire a stake in a Spanish company.

Important: the SIREN/SIRET number or the intra-Community VAT number does not replace the Spanish NIF.

Is it necessary to travel to Spain?

No, provided the procedures are planned well in advance.

With a bilingual French-Spanish power of attorney, Baker Tilly Spain professionals can act on behalf of the client. This allows them to handle the necessary procedures to obtain the NIE and NIF.

To simplify the process, Baker Tilly coordinates the preparation and signing of the power of attorney from France, working with French notaries experienced in French-Spanish transactions.

In addition, Baker Tilly Spain has professionals dedicated to handling these procedures. We therefore regularly process NIE and NIF applications efficiently and generally within short timeframes.

Don't wait until signing or closing

Several aspects need to be identified from the outset of the project: the NIE, NIF, powers of attorney, identification of the ultimate beneficial owner, corporate documentation, apostilles and translations.

When properly prepared, these procedures can be completed quickly. If addressed too late, they can become an obstacle to the transaction.
