New ITSS inspections in 2026: what companies need to review
The Labour and Social Security Inspectorate (ITSS) in Catalonia has announced a strengthening of its inspection activity in 2026, with a 10% increase in complaints and penalties that reached €45 million in 2025.
For this year, an intensification of inspection campaigns is expected, with particular focus on key areas of employment regulatory compliance:
Working time and time recording
Controls on working time recording, overtime and part-time employment contracts will be intensified, especially in sectors such as transport and hospitality.
Non-compliance in relation to working time may lead to financial penalties and liabilities relating to salary and Social Security obligations arising from regulatory breaches.
Equality plans and LGTBI plans
The ITSS will carry out specific campaigns to verify the existence of mandatory equality plans and LGTBI plans, as well as their proper implementation.
Gender pay differences will also be reviewed, and the absence of either plan may be considered an independent breach, with separate penalties applicable.
Occupational risk prevention (ORP)
Monitoring of occupational risk prevention (ORP) will be reinforced, including the assessment of risks arising from weather-related phenomena and the control of psychosocial and ergonomic risks, particularly in sectors such as care homes and call centres.
Digitalisation, artificial intelligence and digital disconnection
The ITSS will review compliance with employees’ right to digital disconnection and the obligation to provide information regarding the use of algorithms affecting working conditions.
New inspection tools and automated monitoring
Inspections relating to LISMI compliance, fraudulent temporary hiring and general labour compliance will also be strengthened.
Particular attention should be paid to the increasing use of algorithms for the automatic detection of irregularities, including the массовое sending of inspection notices and requests to companies.
